Terms and Conditions

Please read these Terms and Conditions carefully as they, together with the specific information about your confirmed accommodation at Gable Cottage, form the basis of your contract with us, the owners of Gable Cottage.

Please take particular note of the Covid-19 clause.

In these conditions “the Guest”, ‘you’ or ‘your’ includes the lead-named person on the Booking Form and all persons on whose behalf a booking is made.

“The Owner”, ‘we’, ‘us’ or ‘our’ means the owners of Gable Cottage or someone acting on the owners’ behalf.

Booking and Payment
When the lead person named on the Booking Form makes a booking he/she guarantees that he/she is aged 18 or over, has the authority to accept and does accept the terms of these booking conditions on behalf of all members of the party booking.

A deposit of 25% of the rental cost is due at the time of booking. If the reservation is made within 8 weeks of your arrival date the full amount is payable upon booking. No contract will exist until we receive this amount and confirm your booking.

The balance is due at least 8 weeks before your stay. If the balance is not received in full and on time, we reserve the right to treat the booking as cancelled by you and cancellation charges will apply.

If the arrangements you wish to book are available, the owner will confirm the booking in writing. A binding agreement will come into existence between the guest and the owner when we despatch this confirmation to the guest.

The lead person whose signature appears on the Booking Form (or an electronic or telephonic agreement of a similar nature) is responsible for:

  • listing all names and addresses of all members of the party on the Booking Form
  • making all payments due and notifying us in writing of any changes or cancellations
  • the conduct of the other members of the party

Damage Deposit
We require a security deposit of £200 to be paid by the guest. This will be refunded within 7 days of the end of the holiday less any charges for breakages or damage for which the guest is responsible and/or charges for additional cleaning beyond the normal cleaning regime.  In the event of any breakage, the guest should let the owner know as soon as possible so that replacements can be arranged promptly.

Alterations and Cancellation by the Owner
Although it is unlikely that we will have to make any significant changes to your booking, or that Gable Cottage ceases to be available as booked, if this happens we will advise you at the earliest possible date. In this event, we will refund you all money you have paid (including the deposit).

Alterations and Cancellation by the Guest
Cancellation must be made in writing by the lead person as soon as possible and will be effective from the date of receipt by us of that written cancellation notice. Money paid at the date of cancellation is non-refundable unless the owner is able to re-let Gable Cottage for the original dates and at the original rate. If re-let the owner is entitled to charge you for administrative work along with any shortfall if the value of the new booking is less than that of the original booking. If you are covered by holiday insurance you may be able to recover these cancellation charges. We recommend that you take our holiday insurance for this reason.

If, once your booking is confirmed, you wish to change any details (e.g. arrival or departure date) we will do our best to accommodate your request. However, if you request an alteration to your dates within 8 weeks of your expected arrival or departure date then cancellation charges will apply.

Where minimum stays apply (e.g. Christmas, Bank Holiday weekends etc.) no alterations can be made without cancellation charges.

Any changes to the names of the people listed in the party on the Booking Form should be advised prior to arrival. The maximum number of people to stay at Gable Cottage must not exceed the advertised capacity.

Prices and other charges
The price of booking Gable Cottage is subject at all times to changes arising from government action, such as changes in VAT or any other government imposed changes that may affect your holiday price. In this event, we reserve the right to alter our advertised accommodation prices or in the event that we make an error. We will advise you of the price of booking Gable Cottage before your contract is confirmed.

We will make an administrative charge in respect of work and expenses associated with a cheque that is returned unpaid. However, if paid on representation this charge will not exceed £50.

Force Majeure
Except where otherwise expressly stated in these booking conditions we will not be liable or pay you compensation if our contractual obligations to you are affected by any event which we could not, even with all due care, foresee or avoid. These events can include, but are not limited to war, threat of war, civil strife terrorist activity and its consequences or the threat of such activity, riot, the act of any government or other national or local authority including port or river authorities, industrial dispute, lock closure, natural or nuclear disaster, fire, chemical or biological disaster and adverse weather, sea, ice and river conditions and all similar events outside our control.

Bookings affected by Covid-19 Government restrictions, or similar events, can be rescheduled or honoured with a voucher for a future stay as a first step prior to refunding. Restrictions refer Government accommodation closures.

These terms refer to Covid-19 but may also apply to other non-specific pandemics.

If you, or any of your party, becomes ill or exhibits symptoms of Covid-19, within 14 days prior to your arrival date you should cancel your booking. We will try to reschedule or offer a voucher for a future stay. A refund will be given if the cottage is re-let.

If you, or any of your party, is contacted by Test and Trace within 14 days of your arrival date you should cancel your booking. We will try to reschedule or offer a voucher for a future stay. A refund will be given if the cottage is re-let.

If you, or any of your party, becomes ill or exhibits symptoms of Covid-19, or is contacted by Test and Trace, during your stay you should return home and self-isolate there. A refund for the balance of your stay will be arranged upon evidence of a Covid-19 test or contact made by Test and Trace.

If you, or any of your party, becomes ill or exhibits symptoms of Covid-19, or is contacted by Test and Trace, during your stay and you cannot return home to self-isolate then any extra cost for your stay beyond your original departure date is payable by you (including any costs related to other affected bookings). An extension to your planned stay will only be agreed upon evidence of a positive Covid-19 test or contact made by Test and Trace.

You should plan for returning home safely by, for example, keeping fuel topped up and having food supplies should you have to drive more than a few hours.

If your booking is affected by previous guest self-isolation or illness, we will contact you to discuss the best way forward.  

The health and safety of our guests, neighbours and those in our wider community is of paramount importance to us, especially during the current Covid-19 situation.

We therefore ask you to:

  • ensure you, and everyone in your party, practices regular hand washing and observes social distancing as per Government guidelines
  • ensure you, and everyone in your party, uses the anti-bacterial handwash and the 70% alcohol hand sanitiser provided in the cottage regularly
  • contact us if you, or anyone in your party, develops symptoms of Covid-19 (or is contacted by Test and Trace) within 14 days of your return home

Owners’ Obligations
The accommodation at Gable Cottage will be provided using reasonable skill and care. This means that we will accept responsibility if your contracted arrangements are not provided as promised or prove deficient as a result of the failure of ourselves, our employees, agents or suppliers to use reasonable skill and care in providing your arrangements. However, it is your responsibility to show that reasonable skill and care has not been used if you wish to make a claim against us.

We have no liability in the following situations:

  • where the accommodation cannot be provided as booked due to circumstances beyond our control
  • where you incur any loss or damage that could not have been foreseen at the time of your booking, based on the information provided by you
  • where you incur any loss or damage that relates to any business activity
  • where any loss or damage relates to any services which do not form part of our contract with you
  • where there is any temporary defect or stoppage in the supply of services to Gable Cottage, nor in respect of any equipment or appliances in the cottage or grounds
  • if Gable Cottage is destroyed or substantially damaged before your arrival date. However, in such an event we would notify you and arrange a refund within 7 days of that notification
  • any damage to your vehicle(s)

If we are found liable to you on any basis, we limit the amount we have to pay you to a maximum of twice the cost of your accommodation. This limit does not apply to cases involving death or injury.

Guest’s Responsibilities
We recommend that you take our holiday insurance to protect your payment in the even you wish to cancel your booking.

Your booking is not transferable. Only those guests whose names and addresses appear on the Booking Form or similar paper records may stay overnight in Gable Cottage unless we give permission for overnight guests of the guest to be accommodated in addition to the pre-booked party. Day guests in reasonable numbers (and in all cases, within the numbers intended for the accommodation in question) may be entertained in Gable Cottage but we reserve the right to require advance notice of any such invitation. If persons whose names do not appear on the Booking Form or other records, and for whom no permission to stay has been granted by us, are found to be staying overnight in Gable Cottage we reserve the right to terminate the holiday without compensation.

Gable Cottage is for holiday use only and the guest is not permitted to conduct a business, trade or profession (other than the maintenance of business communications by telephone, post or electronic means) from the premises without our written approval.

All party members should apply normal security precautions for the prevention of theft or burglary including locking all doors and securing all windows when the property is unoccupied and the securing of doors whilst the occupants are asleep to prevent entry by an intruder.

The guest should take good care of Gable Cottage. This includes ensuring rubbish and/or recycling is put out prior to collection times and that the cottage is left in a clean and tidy condition at the end of the rental period, ensuring that kitchen surfaces are free from grease, and that litter and refuse is placed in bags or receptacles that are provided for that purpose. We may make charge for additional cleaning work if the cottage is left in a dirty condition or an abnormal amount of refuse needs to be disposed of.

In the event of damage to the premises or any of the owners’ property, or loss of the owners’ equipment, the guest must inform us immediately. However, minor damage or loss need not be reported between 2000 hours and 0800 hours. The owner may make a reasonable charge for replacement of lost keys.

If we or any other person in authority is of the reasonable opinion that you or any member of your party is behaving in such a way as to cause or be likely to cause danger or upset to any other person or damage to property, we will be entitled to terminate the holiday of the person(s) concerned. The person(s) concerned will be required to leave the accommodation or other service and we will have no further responsibility to them. No refunds will be made and we will not pay any expenses or costs incurred as a result of the termination.

You will be responsible for making full payment for any damage or loss caused by you or any member of your party during your stay with us. Payment must be made direct at the time to us failing which, you will be responsible for meeting any claims subsequently made against us (together with our own and the other party’s full legal costs) as a result of your actions.

The owner has a right to enter Gable Cottage at any reasonable time for essential repairs and this right extends to any tradesperson or maintenance worker appointed by us. In an emergency where the safety or security of Gable Cottage or its occupants is endangered, or serious damage to the cottage would ensue if an emergency repair were not carried out, this right may be exercised at any time of the day or night. We will endeavour, so far as practicable in the circumstances, to make the best possible arrangements for your continued comfort and that of your party, to keep you informed about the progress of the work, and to carry out the work at a time convenient to you where this can be arranged. The owner may enter the premises at any reasonable time to carry out an inspection or for other purposes.

Fireworks are not permitted to be used or brought onto the premises or grounds unless the owner has given express written permission for them to be used or brought in.

The guest must treat the property’s neighbours with respect at all times and in particular must ensure that the level of noise emanating from Gable Cottage is reasonable at all times. Between 2300 and 0800 noise must be kept to a low level that does not cause any disturbance to local residents. You must ensure that proper control is exercised over children and animals (if permitted) and that vehicle doors are closed quietly and horns not used unnecessarily. Refuse must not be left in a position to cause inconvenience to neighbours and the parking of vehicles must be carried out with due consideration for neighbours. Animals in the custody of the guest and his/her party (if permitted) must not be allowed to stray onto neighbours’ property.

No electric appliances (other than radios, mobile telephones, portable computers, and other small consumer electronic devices) may be brought into Gable Cottage without our permission. We reserve the right to prohibit smoking and vaping in the premises or grounds.

Accuracy
We will describe Gable Cottage honestly and without omitting significant information but minor variations from the website description may occur as a result of maintenance, painting, improvements or replacement of fixtures and fittings. We will inform you of any significant variations compared to the website description. Significant variations are those that, in the opinion of a reasonable person, would have a substantive effect on the enjoyment of a holiday at Gable Cottage.

We take great care to provide accurate information about Gable Cottage and the general area in which it is located. However, there may be occasions when facilities which are not under our direct control may not be available. We will endeavour to inform you of any such changes in advance, although these will not in themselves necessarily entitle you to cancel your booking without the usual penalties.

Complaints
If you have a complaint about any aspect of Gable Cottage you should bring this to our attention at the earliest opportunity (between 0800 and 2000) to give us the opportunity to address the issue. Any verbal notification must be put in writing within 21 days of the end of your stay at Gable Cottage. Such complaints should include all relevant information together with your booking reference. Failure to do so will affect our ability to investigate your complaint, and will affect your rights under this contract.

Rural Properties
All members of the party must understand that as Gable Cottage is in a rural area the presence of wildlife and farm animals is to be expected. This can lead to agricultural odours, bird noise, and minor nuisance from animals. These things are part of rural life and unavoidable.

Public Utilities
The owner takes no responsibility for the failure of public utilities including suppliers of electricity, gas, telephone, Internet, cable television or water services.

Law and Jurisdiction
English Law will apply to our agreement and to any dispute or claim which arises between us out of it. Any such dispute or claim must be dealt with under the EASCO Arbitration Scheme or by the Courts of England and Wales. Residents of Scotland or Northern Ireland may however, choose the law and jurisdiction of Scotland or Northern Ireland as applicable.

Pets
Pets are welcome and a fee of £25 is chargeable. We can welcome up to two dogs. Registered assistance dogs are free. The person in charge of the pet should ensure that:

  • it is house trained
  • it is kept off upholstered furniture
  • it is not allowed upstairs
  • it is not left alone in the cottage
  • faeces are removed and disposed of appropriately
  • vaccinations, flea and worm treatments are up to date

We may apply an additional cleaning charge if these booking conditions are not met

Additional Local Conditions
Arrival and Departure Times
Your booking begins at 4pm on the start date and ends at 10am on the end date, unless otherwise agreed with us in advance. Should a late departure (unless agreed in advance) delay the start of the next guest’s stay you will be responsible for reimbursing any costs. These times are subject to change due to the additional Covid-19 cleaning measures now in place.

Internet Access
There is free Wi-Fi at Gable Cottage. However, the speed and availability is outside our control. We will do our best to maintain the connection but will not be liable for any loss of service. You should use the Internet responsibly and ensure that illegal or pirated material is not viewed or downloaded.

Keys
At the end of your stay you should ensure all windows and doors are locked and leave the keys in the key-box provided
